Definition of Terms
The terms pertaining to subscriptions to the Regulatory Information Services are defined below.
Authorized User. See "user".
Billing period. The minimum time interval during the subscription term
for which the license fee is prepaid. The duration of the billing period
depends on the payment schedule chosen by the subscriber: monthly, quarterly,
semi-annually, or annually.
Client. See "subscriber".
Controlled group. A large company with a diversified organizational
structure and a network of subsidiary companies. A controlled group includes
the parent company (holding company) and all divisions, branches, and other
organizations and individuals in which 100 percent of the shares or votes
belong to the parent company.
Database. An information product (such as the Database of Industry
Standards of the Republic of Kazakhstan) in the form of an electronic database
containing bibliographic data and full texts of publications such as laws,
technical regulations, industry standards, specifications, manuals,
guidelines, engineering data, and related statutory regulations. The product
comes with an installation software used to install the Database in the
subscriber’s computer system. The Database is provided to subscribers on the
basis of the Database End-User License, with "one copy of the Database per one
Database End-User License".
Database (trial version). The trial version of the Database ("Trial
Database") is intended for purposes of familiarization with the working
version of the Database and is provided for a limited time to individuals who
have expressed an interest in subscribing to the Regulatory Information
Services. The Trial Database is provided on the basis of the Trial Database
End-User License.
Database (working version). The working version of the Database is a
package consisting of fully functional Database and devices, which is provided
to the subscriber on the basis of the Database End-User License.
Database End-User License. The license agreement that permits the
subscriber to install and use the Database under the terms and conditions
stipulated in the license agreement.
Database of Industry Standards of the Republic of Kazakhstan. A
Database containing bibliographic data and full texts of the regulatory
documents in use in Kazakhstan.
License. The license agreement between the licensee and licensor that
stipulates the terms and conditions for installation and use of the product
being licensed.
License Agreement. See "license".
Licensee. The individual or legal entity to which the license is
issued.
License fee. The sum which the subscriber is obligated to pay for each
license for each billing period during the subscription term. The license
fee represents the price of the license.
Licensor. The individual or legal entity that issues the license.
Subscriber. An individual or legal entity that is the subject of the
Subscription Agreement. The term "subscriber" is understood to mean the
subscriber and user together.
Subscription Agreement. The agreement between the subscriber and the
vendor of the information services. This agreement is the fundamental document
regulating the terms and conditions of the subscription to the Regulatory
Information Services.
Subscription term. The total time period during which information
services are provided to the subscriber, provided that the terms and
conditions of the Subscription Agreement are complied with. For payment
purposes, the subscription term is divided into billing periods.
Third party. An individual or legal entity that is not a subscriber, an
employee of the subscriber, or a member of a controlled group. For example,
third parties include clients and customers of the licensee; business partners
of the licensee; vendors of products and services to the licensee, including
licensee’s independent contractors who are not salaried staff employees of the
licensee; partners or members of joint ventures and consortia that include the
licensee; legal entities less than 100 percent controlled by the licensee.
Trial Database. See "Database (trial version)".
Trial Database End-User License. A license agreement with limited
rights and a limited term that permits the licensee to install and use the
Trial Database.
Working version of the Database. See "Database (working version)".
User. An individual authorized by the subscriber to install and/or
access and use the Database by means of the User Software. Users must be
salaried staff employees of the subscriber, and not of the subscriber`s
clients, vendors, consultants, service providers, agents, contractors,
subcontractors, business partners, consortium partners, joint venture
partners, affiliates (other than wholly owned subsidiaries), concessionaires,
subscribers, members, or associative/cooperative members and employees
thereof.
User Software. The computer program that is used to access the
Database. The User Software is provided to subscribers free of charge. The
installation and use of the User Software is governed by the User Software
License.
User Software License. The license agreement that permits the user to
install and use the User Software under the terms and conditions stipulated in
the license agreement.
