Legislative Approval of a Technical Regulation
After receiving the finding of the expert commission,
the developer sends a proposal for review of the draft to the highest
legislative or executive authority.
A technical regulation may be enacted in the form of a
federal law, a resolution of the Cabinet, or an order of the President of the
Russian Federation. If the developer feels that a technical regulation should
be enacted in the form of a federal law, the proposal for review of the draft
is sent to the State Duma. Alternatively, if a resolution of the Cabinet is
sufficient for enactment of the given technical regulation, the developer may
decide to send the proposal to the Cabinet.
As a rule, review of a draft of a technical regulation
by the Cabinet should take no more than a month. The review of a draft of a
technical regulation by the State Duma is a longer process, since the
legislators discuss the draft in three phases.
A technical regulation approved by the State Duma enters
into force no earlier than six months after official publication. The
timeframe for enactment of technical regulations approved by a resolution of
the Cabinet is determined by the Cabinet.
